ABOUT US

Swiss Fiat is the commercial brand of Swiss Fiat AG. The company is affiliated with d'Organisme de Surveillance pour Intermédiaires Financiers & Trustees (SO-FIT) under affiliation no. 1524. SO-FIT is a self-regulatory organization recognized by the Swiss Financial Market Supervisory Authority (FINMA) for the oversight of financial intermediaries pursuant to Article 2 paragraph 3 of the Swiss Anti-Money Laundering Act (AMLA). As Swiss Fiat is not directly supervised by FINMA, any regulatory matters are overseen by SO-FIT.

For the purposes of these Terms of Use, "Swiss Fiat" refers to Swiss Fiat AG, registered in the Swiss Commercial Register under company number CHE-311.324.141, with its registered office at Alpenstrasse 1, 6004 Lucerne, Switzerland.

Swiss Fiat is not a bank. Client funds are therefore not protected under the Swiss Deposit Protection Scheme, which safeguards deposits up to CHF 100,000 with licensed Swiss banks and securities dealers.

References to Swiss Fiat include the company as well as its shareholders, directors, employees, and representatives.

Swiss Fiat operates as a facilitator platform, connecting clients with authorized and regulated third-party service providers ("Partners"). By registering with Swiss Fiat, you agree that your identity verification data and supporting documents may be shared with these partners for compliance and service provision purposes. Throughout your use of the platform, such personal data will be handled securely and transmitted only to the relevant partners as necessary to deliver the requested services. All client funds are held exclusively with regulated financial institutions.

ACKNOWLEDGMENTS

By accessing this website ("Site"), registering for a Swiss Fiat Account ("Account"), or using any Swiss Fiat services, you ("you," "your," or "Client") agree to be bound by these Terms of Use. Please read the Terms of Use carefully in their entirety before using the Site or any Swiss Fiat services.

If you do not agree with any part of these Terms, you must not access the Site or use our services.

Certain features may not be available depending on your country of residence. It is your sole responsibility to comply with all laws and regulations applicable in your country of residence and in any jurisdiction from which you access the Site or Services.

Subject to your acceptance and continued compliance with these Terms of Use, Swiss Fiat grants you a personal, limited, non-exclusive, non-transferable, and non-sublicensable right to access and use the Site and Services.

Please note that the equivalent value of assets in your Swiss Fiat Account may be represented in different asset classes, which may have varying degrees of liquidity.

DEFINITIONS

Account (or Profile):

A contractual arrangement under which a Swiss Fiat Member has accepted these Terms of Use and the Privacy Policy, and has been approved to access Swiss Fiat services. This may include opening an IBAN account, obtaining a debit/credit card, buying or selling cryptocurrencies, and using services provided directly by Swiss Fiat or its regulated partners.

Account Deletion:

The permanent closure and termination of a Member's Swiss Fiat Account, including the deactivation of all associated services and the secure handling of personal and financial data in accordance with regulatory requirements and applicable data protection laws.

Beneficial Owner:

Any natural person who ultimately owns or controls a Client (legal entity or foreign undertaking), or the natural person on whose behalf a transaction is carried out.

Bitcoin (BTC):

A peer-to-peer digital currency described at Bitcoin.org

Cryptocurrencies:

All forms of digital assets, including but not limited to Bitcoin, Ethereum, USD Coin, and Tether.

Buyer(s):

Member(s) submitting an offer to purchase cryptocurrencies or other supported assets through the Service.

Commission or Fee:

Charges payable to Swiss Fiat for the provision of services, as set out in these Terms of Use, supplements, or on a per-transaction basis (e.g., cryptocurrency buy/sell transactions).

Company:

Swiss Fiat AG, CHE-311.324.141, operating under the brand "Swiss Fiat." The Company is an affiliated member of SO-FIT (affiliation no. 1524), with its registered office at Alpenstrasse 1, 6004 Lucerne, Switzerland.

Member(s) or Client(s):

A natural or legal person accepted by Swiss Fiat AG as a client, to whom services are provided under these Terms.

Personal Data:

Information that identifies an individual, such as name, address, email address, and account or transaction details. Aggregated or anonymized information that does not identify an individual is not considered Personal Data.

Price:

The "price per coin" at which Members are willing to purchase or sell cryptocurrencies via the Service. Prices may be expressed in supported fiat currencies deposited into a Member's Account. (Swiss Fiat may limit services to specific currencies, such as EUR, depending on availability.)

Seller(s):

Member(s) submitting an offer to sell cryptocurrencies or other supported assets through the Service.

Service(s):

The Swiss Fiat platform, including its technological infrastructure, KYC/AML framework, functional rules, and marketplace functionalities. Services may include cryptocurrency trading, fiat/crypto conversion, IBAN accounts, card issuance, and services delivered by regulated third-party partners.

Transaction:

Any operation carried out via the Service, including but not limited to:

  • Buying or selling cryptocurrencies at the current market rate;

  • Transferring cryptocurrencies between Members ("Transfer Transaction");

  • Transferring fiat currencies between Members ("Currency Transfer Transaction");

  • Payment of the Transaction Price, meaning the total consideration paid by the Buyer in a purchase or exchange.

BUSINESS MODEL AND SUPERVISION

Swiss Fiat provides a secure digital platform that enables Clients to:

  • Buy and sell cryptocurrencies (e.g., BTC, ETH, USDC, USDT);

  • Access multi-currency IBAN accounts via licensed third-party institutions;

  • Obtain physical and virtual debit cards linked to their account balances;

  • Convert between fiat and cryptocurrencies, as well as between supported fiat currencies.

All services are delivered either directly through Swiss Fiat's platform or via regulated and authorized third-party financial service providers. Client funds are safeguarded by licensed institutions, and digital assets are protected using institutional-grade custody solutions.

Among Swiss Fiat's regulated partners, multi-currency IBAN accounts and payment services may be provided by Equals Money PLC, authorised by the Financial Conduct Authority to provide payment services (FCA No. 488396). Company registered in England and Wales, with the Registration No. 05539698. Registered Address: 3rd Floor, Vintners' Place, 68 Upper Thames St, London, EC4V 3BJ, UK.

Certain payment services may also be provided through SettleGo Solutions Limited (trading as OpenPayd), a company registered in England with company number 09570221 and authorised and regulated by the Financial Conduct Authority as an Electronic Money Institution (Firm Reference Number: 900483).

Swiss Fiat AG is an affiliated member of SO-FIT – Organisme de Surveillance pour Intermédiaires Financiers & Trustees (affiliation no. 1524), a recognized self-regulatory organization (SRO) under the oversight of the Swiss Financial Market Supervisory Authority (FINMA). ACCOUNT CREATION AND VERIFICATION

The creation and use of a Swiss Fiat Account is subject to verification procedures required under Swiss law and applicable regulatory obligations. You agree to provide all information and documentation requested by Swiss Fiat for the purposes of:

  • Identify verification;

  • Compliance with Know-Your-Customer (KYC) and Anti-Money Laundering (AML) rules;

  • Detection and prevention of money laundering, terrorism financing, fraud, or other financial crime.

The information requested may include Personal Data (see our Privacy Policy). By submitting this information, you confirm that it is accurate, complete, and up to date, and you agree to promptly notify Swiss Fiat of any changes.

Your Account will remain blocked until Swiss Fiat is satisfied, at its sole discretion, that the information provided is sufficient to validate your Account. During this period, you may not terminate your Account or request the deletion of Personal Data collected for verification purposes.

Swiss Fiat uses both internal compliance procedures and trusted third-party service providers (e.g., KYC/AML technology tools) to perform verification and screening.

Swiss Fiat is under no obligation to accept an applicant as a Client and may refuse applications where regulatory requirements, AML checks, or internal risk criteria are not met. Additional due diligence may be applied to Clients from certain jurisdictions or industries.

Each Client is permitted only one active Account (Profile). If multiple Profiles are created, Swiss Fiat reserves the right to consolidate them into a single Account or request that the Client designate a primary Profile, with duplicates terminated or merged where technically feasible.

ACCOUNT OPENING ELIGIBILITY

The Services are available to and may only be used by individuals or companies who can form legally binding contracts under the law applicable to their country of residence.

By registering for an Account, you expressly represent and warrant:

  • That you have accepted these Terms of Use and Privacy Policy

  • That you are at least 18 years of age;

  • That you are not a citizen or resident of the countries which the Company does not accept as Clients;

  • That you have capacity to act, i.e., to create rights and obligations through your actions.

Without derogating from the above, the Company reserves the right, acting reasonably, to suspend and/or refuse access to and use of the Company's service(s) and/or system(s) and/or Platform to anyone in our sole and absolute discretion.

MAINTAINING YOUR ACCOUNT

This Site and the Swiss Fiat Services are provided solely for your personal, lawful, and noncommercial use. By registering with Swiss Fiat, you agree to provide and maintain accurate, current, and complete information as requested during the registration process. Failure to do so constitutes a breach of these Terms and may result in immediate suspension or termination of your Account.

You may only use your own Account. You may not use another Member's Account, allow others to use your Account, or assist any person in gaining unauthorized access. The creation or use of duplicate or unauthorized Accounts without Swiss Fiat's prior written consent will lead to immediate suspension of all such Accounts, cancellation of pending offers, and may result in further legal or regulatory action.

You are solely responsible for safeguarding your Account credentials, including your password and two-factor authentication (2FA). All transactions and activities carried out using your login credentials are deemed to have been authorized by you and are irrevocable once validated. Cryptocurrency transactions are final and cannot be reversed once submitted to the blockchain; therefore, it is your responsibility to verify recipient addresses and transaction details before confirming any transfer.

If we detect or suspect unusual or suspicious activity, Swiss Fiat may request additional information or supporting documents, and may temporarily freeze transactions pending review. Failure to comply with such security requests may result in the suspension or closure of your Account.

You must notify Swiss Fiat immediately of any unauthorized access, suspected security breach, or misuse of your Account. Please contact us at support@swissfiat.com

Use of the Swiss Fiat Services for criminal, fraudulent, or prohibited activities, including but not limited to money laundering, terrorist financing, sanctions violations, illegal gambling, hacking, or any other unlawful conduct, is strictly forbidden. Breach of this rule will result in immediate termination of your Account and may trigger regulatory reporting obligations.

ACCOUNT DELETION AND CLOSURE

You may request the deletion and closure of your Swiss Fiat Account at any time. However, due to regulatory compliance requirements and the sensitive nature of financial data, account deletion requests must be processed through our dedicated support team to ensure proper handling and regulatory compliance.

Closure Requirements: Before requesting account deletion, you must ensure that:

  • All your accounts and currency accounts have a balance of zero;

  • You have no pending transactions or outstanding obligations;

  • You have waited at least 2 business days for all payments to settle after completing any cryptocurrency transactions;

  • You have withdrawn all available funds above the minimum withdrawal threshold;

  • All associated payment cards have been deactivated and returned (if applicable);

  • You have no active subscriptions or recurring services.

To initiate an account deletion request, you must:

  1. Contact our support team at support@swissfiat.com with your deletion request;

  2. Provide proper identification and verification to confirm account ownership;

  3. Confirm that all closure requirements listed above have been met;

  4. Comply with any additional verification or documentation requirements as requested by our support team.

Processing Timeline: Account deletion requests are typically processed within 30 business days from the date we receive your complete request and all required documentation. This timeframe may be extended if additional compliance checks are required or if there are pending regulatory obligations.

Data Retention: Following account closure, certain personal and transaction data may be retained for the periods required by applicable laws and regulations, including but not limited to Swiss Anti-Money Laundering Act (AMLA) requirements, tax obligations, and other regulatory compliance purposes. This retention is necessary to fulfill our legal obligations as a regulated financial intermediary.

Restrictions on Deletion: We reserve the right to refuse or delay account deletion requests in the following circumstances:

  • Ongoing investigations or compliance reviews;

  • Pending transactions or unresolved disputes;

  • Outstanding obligations or liabilities;

  • Legal or regulatory requirements preventing immediate closure;

  • Suspected fraudulent activity or security concerns.

Effect of Account Deletion: Upon successful account deletion:

  • Your access to all Swiss Fiat services will be permanently terminated;

  • All associated payment cards will be deactivated;

  • Any remaining account balances below the minimum withdrawal threshold (€10) may be written off;

  • You will no longer receive communications from Swiss Fiat, except as required by law.

This account deletion process ensures compliance with applicable financial regulations, protects against unauthorized account closures, and maintains the integrity of our regulatory reporting obligations. The requirement to contact our support team directly prevents accidental or unauthorized deletion of accounts containing regulated financial information.

FUNDING YOUR ACCOUNT

You may add funds to your Swiss Fiat Account using supported methods such as credit/debit card or wire transfer.

Swiss Fiat does not accept third-party or anonymous payments. The payment instrument you use (card or bank account) must be registered in your own name and match the details of your Swiss Fiat Account. Payments made from accounts belonging to other persons will be rejected.

Swiss Fiat may request documents at any time to verify the ownership and validity of your payment method. If we cannot verify the details, or if we determine that the account does not belong to you, the deposit will not be processed and you may be restricted from using our services.

All deposits are subject to compliance checks. While some transactions may be processed automatically up to a defined limit, Swiss Fiat reserves the right to conduct additional reviews and request supporting documentation; particularly for first-time deposits or where discrepancies are identified. Wire transfers may require between 1–7 business days to clear.

Swiss Fiat also reserves the right to request documentation at any time to confirm the source of funds. Deposits may be rejected if the Company is not reasonably satisfied as to their legality or origin.

Please note that Swiss Fiat accepts no responsibility for charges, fees, or exchange rate differences applied by your financial institution in connection with deposits. All such costs are borne solely by you.

TRANSFER / WITHDRAWAL

You may request to withdraw funds from your Swiss Fiat Account at any time via wire transfer (SEPA and/or international transfer), subject to the following conditions:

  1. The withdrawal request must contain all required information.

  2. Withdrawals can only be executed to a bank account held in your own name. Payments to third-party or anonymous accounts are strictly prohibited.

  3. The requested withdrawal must meet the minimum limit of €10. Balances below this threshold will remain in your Account until additional deposits raise the balance above the minimum or until the Account is closed. Upon closure, any remaining balance below the minimum may be written off at Swiss Fiat's discretion.

The destination of outgoing transfers must always correspond with the account used for incoming deposits. Withdrawals may only be made to an account in your country of residence and in your own name. No alternative withdrawal methods are permitted.

ACCOUNT BALANCE WRITE-OFFS

Upon closure of a Swiss Fiat Account, if the remaining balance is below the minimum withdrawal limit of €10, Swiss Fiat reserves the right to write off this balance. By accepting these Terms of Use, Clients acknowledge and agree that this policy applies to all Accounts, whether new or existing.

This write-off mechanism is applied solely to ensure operational efficiency and regulatory compliance and does not affect balances equal to or greater than the minimum withdrawal limit.

CRYPTO EXCHANGE AND TRADING

Every verified and eligible SWISS FIAT AG Client is able to use cryptocurrency wallet and cryptocurrency exchange services provided by third-party service provider. Cryptocurrency withdrawals requires 2FA (two-factor authentication). When Client exchanges cryptocurrencies in EUR, the service is provided by SWISS FIAT AG. When you exchange cryptocurrencies in USD or make a FIAT currency exchange (i.e. EUR/USD/CHF conversion), Client is automatically referred and this service is provided by third-party service provider (see Services provided by Swiss Fiat third-party service providers).

Swiss Fiat platform allows verified Clients to:

  • Buy and Sell (exchange) cryptocurrency.

  • Transfer cryptocurrency and FIAT currency to another person.

Client must review and accept Terms of use, Privacy Policy and Risk Disclosure prior to using of the Crypto Exchange services. By using these services, Client agrees to be bound by Terms of Use, Privacy Policy and Risk Disclosure.

RISK WARNING

The trading of goods and products, real or virtual, as well as virtual currencies involves a significant risk. Prices can and do fluctuate on any given day. Such price fluctuations may increase or decrease the value of your assets at any given moment. Any currency, virtual or not, may be subject to large swings in value and may even become worthless. There is an inherent risk that losses will occur as a result of buying, selling, or trading anything on a market.

Trading cryptocurrencies also has special risks not generally shared with official currencies, goods, or commodities in a market. Unlike most currencies that are backed by governments, other legal entities, or commodities such as gold or silver, cryptocurrencies are a unique type of Internet digital currency, backed by technology and trust. There is no central bank that can issue more currency or take corrective measures to protect the value of cryptocurrencies in a crisis.

Instead, cryptocurrencies are an as-yet autonomous and largely unregulated global system of firms and individuals. Traders put their trust in a digital, decentralized, and partially anonymous system that relies on peer-to-peer networking and cryptography to maintain its integrity.

The trading of cryptocurrencies is often susceptible to irrational bubbles or loss of confidence, which could collapse demand relative to supply. For example, confidence might collapse in cryptocurrencies because of unexpected changes imposed by software developers or others, a government crackdown, the creation of superior competing alternative currencies, or a deflationary or inflationary spiral. Confidence might also collapse because of technical problems: if the anonymity of the system is compromised, if money is lost or stolen, or if hackers or governments are able to prevent any transactions from settling.

There may be additional risks that we have not foreseen or identified in these Terms of Use. You should carefully assess whether your financial situation and tolerance for risk are suitable for buying, selling, or trading cryptocurrencies.

We use our third party providers in order to receive client funds and make payments.

FEES

Our fees charged are disclosed on a per transaction basis.

Other charges: The Company reserves the right to charge extra service fees for any documents requested by you for a personal use such as but not limited to acknowledgement letters, account confirmation letters for tax purposes or communication retrieval other than already included in the dedicated section for data transfer on the Client's portal. The Company will communicate the fees to you upon receiving a request for any of the requested documentation.

Chargebacks and similar costs, that may arise from incorrect transactions will be borne by you.

THIRD-PARTY SERVICES

By using the Platform, you are required to agree to the respective Agreements, Terms and Conditions and Privacy Policies of each respective service provider, depending on the services you would like to use. You may be prompted to read and acknowledge these legal documents upon applying for such product or service when requesting services outside of Swiss Fiat Platform.

Where Swiss Fiat provides multi-currency IBAN accounts and payment services through Equals Money PLC, you agree to be bound by Equals Money's Terms and Conditions, in addition to these Terms of Use.

Where such services are provided through SettleGo Solutions Limited (trading as OpenPayd), you agree to be bound by OpenPayd's Terms of Use, in addition to these Terms of Use. You will be notified of the applicable service provider and their respective terms upon applying for such services.

TERMINATION

The Terms of Use enter into force on the day you register for the Profile and are valid as long as you have an Account with us. We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms of Use.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service. However, do note that you may not close your Account / terminate this Terms of Use to avoid an investigation. If you attempt to close your Account / terminate this agreement while Swiss Fiat is investigating, we may freeze the Profile / Account (s) to protect all parties to the Swiss Fiat services, its affiliates, or a third party against any liability. You will remain liable for any obligations related to your Swiss Fiat Account and your activity even after it is closed.

The termination of your Profile / Account will not affect any of our rights or your obligations arising under these terms of use. Any terms which by their nature should survive, will survive the termination of your Profile / Account.

Customers may terminate their use of the payment card services by notifying Swiss Fiat.com. Upon termination, the customer must follow the procedures specified by the third-party provider regarding the deactivation and return of the payment card, if applicable. Swiss Fiat reserves the right to terminate access to the payment card services if the customer violates any terms of service or if there are legal or regulatory reasons requiring such action.

INTELLECTUAL PROPERTY AND LIMITED RIGHT OF USE

Unless expressly stated otherwise, all content, materials, and data available on this Site ("Materials") are the exclusive property of Swiss Fiat AG or its licensors, and are protected by copyright, trademark, and other applicable intellectual property laws.

You may view, download, and/or print a copy of the Materials from this Site on a single device solely for your personal, informational, and non-commercial use, provided that you retain and respect all copyright and proprietary notices contained therein.

All trademarks, service marks, trade names, and logos displayed on the Site are the property of Swiss Fiat or their respective owners. All software, text, images, graphics, charts, data, video, audio, pricing information, and related materials are likewise protected and may not be used without authorization.

You are strictly prohibited from copying, reproducing, modifying, republishing, uploading, posting, transmitting, scraping, harvesting, distributing, or otherwise exploiting the Materials in any form or by any means; manual, automated, or otherwise. Any unauthorized use, including use of the Materials on another website or in a networked computer environment, may violate copyright, trademark, or other applicable laws, and may result in civil or criminal liability.

AVAILABILITY OF SERVICES

All services are provided without warranty of any kind, either express or implied, and in particular without implied warranties of merchantability and fitness for a particular purpose. We do not guarantee that this Site will be available 100% of the time to meet your needs. We will strive to provide you with the Service as soon as possible, but there are no guarantees that access will not be interrupted or that there will be no delays, failures, errors, omissions, or loss of transmitted information.

We will use reasonable endeavors to ensure that the Site can be accessed by you in accordance with these Terms of Use. However, we may suspend the use of the Site for maintenance and will make reasonable efforts to give you notice of this. You acknowledge that this may not be possible in an emergency, and accept the risks associated with the fact that you may not always be able to use the Site or carry out urgent transactions using your Account.

APIS AND WIDGETS

We may provide certain parties with access to specific data and information through our API (Application Programming Interface) or widgets. We also may provide widgets for your use to enter our data on your Site. You are free to use these in their original unmodified and un-altered state.

EXTERNAL WEBSITES

Swiss Fiat makes no representations whatsoever about any external or third-party website you may access through the Site. Occasionally, the Swiss Fiat website may provide references or links to other websites ("External Websites"). We do not control these External Websites or third-party sites or any of the content contained therein. You agree that we are in no way responsible or liable for the External Websites referenced or linked from the Swiss Fiat website, including but not limited to website content, policies, failures, promotions, products, opinions, advice, statements, prices, activities and advertisements, services, or actions, and/or any damages, losses, failures, or problems caused by, related to, or arising from those sites. You shall bear all risks associated with the use of such content.

External Websites have separate and independent Terms of Use and related policies. We request that you review the policies, rules, terms, and regulations of each site that you visit. It is up to you to take precautions to ensure that whatever you select for your use is free of items such as viruses, worms, Trojan horses, and other items of destructive nature.

FINANCIAL ADVICE

Swiss Fiat does NOT provide any investment advice in connection with the Services described in these Terms of Use. Any decision to use Swiss Fiat Partner's services such as purchase or sell cryptocurrencies through SWISS FIAT AG or other available services through other Partners, is solely your decision and we shall not be liable for any loss suffered.

DATA PROTECTION

Privacy is very important to us. Full details of our Privacy Policy can be found on our Privacy Policy page. We recommend that you read the Privacy Policy carefully, so that you know the data that we collect, how we use the data and who we share your data with.

TRACKING OPTION FOR USERS OPERATING IOS

For users operating iOS 14.5, iPadOS 14.5, tvOS 14.5 or later, Swiss Fiat may use the App Tracking Transparency framework to request your permission to enable tracking.

Tracking, if permitted, is used exclusively to:

  • Enhance the functionality and performance of the Swiss Fiat application;

  • Provide an improved and more personalized user experience;

  • Optimize future advertising relevance, if such functionality is introduced.

If you consent, the data collected will be used solely for these stated purposes. The App Tracking Transparency framework will present a clear authorization request before any tracking takes place, and you may choose to grant or deny permission at your discretion.

DISCLOSURES TO LEGAL AUTHORITIES AND AUTHORIZED FINANCIAL INSTITUTIONS

We may share your Personal Data with law enforcement, data protection authorities, government officials, and other authorities when:

  • Required by law;

  • Compelled by subpoena, court order, or other legal procedure;

  • We believe that disclosure is necessary to prevent damage or financial loss;

  • Disclosure is necessary to report suspected illegal activity;

  • Disclosure is necessary to investigate violations of our Terms of Use or Privacy Policy;

LIMITATION OF LIABILITY

To the extent permitted by law, Swiss Fiat will not be held liable for any damages, loss of profit, loss of revenue, loss of business, loss of opportunity, loss of data, indirect, or consequential loss, unless the loss suffered arose from gross negligence or willful deceit or fraud. Nothing in these Terms of Use excludes or limits the liability of either party for fraud, death, or personal injury caused by its negligence, breach of terms implied by operation of law, or any other liability which may not be limited or excluded by law. Although Swiss Fiat endeavors to provide accurate and timely information on the Site, the Site may not always be entirely accurate, complete or current and may include errors. We may change or update the Site at any time without notice, and you should accordingly verify with independent sources all information before relying on it to take decisions or actions. You remain entirely responsible for your decisions and actions. When Swiss Fiat is facilitating card issuance services, Swiss Fiat is not liable for any issues related to the card issuance, including but not limited to card malfunctions, chargebacks, or any disputes arising from the use of the payment cards. These responsibilities lie with the card issuers. Swiss Fiat's responsibilities are limited to providing customer support related to the card issuance process and assisting with any queries related to the services offered through its platform. We can face technical or system error which is beyond the Company’s reasonable control. There may occur events such as power supply, telecommunication issues, natural disasters etc. that cause system interruption beyond the service providers’ control. When such an error occurs during the execution of clients’ requests the Company accepts no liability with the exception of any grossly negligence, fraudulent, dishonest or criminal conduct on the part of the Company, its directors, its officers or employees when acting within the scope of the service agreement. Subject to the foregoing, Swiss Fiat‘s aggregate liability for claims based on events arising from or in connection with any single Member’s use of the Site and/or Service, whether in contract or tort (including negligence) or otherwise, shall in no circumstances exceed the greater of either (a) the total amount held on Account for the Member making a claim less any amount of Commission that may be due and payable in respect of such Account; or (b) 100% of the amount of the Transaction(s) that are the subject of the claim less any amount of Commission that may be due and payable in respect of such Transaction(s). You should be also aware that in some cases intermediary entities may hold the funds you attempt to deposit or withdraw from your Account, which may delay the transfer of funds and which the Company has no control over. The Company will not be held liable for such actions or omissions by intermediary entities.

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Swiss Fiat, its subsidiaries, affiliates, and its licensors do not warrant that (a) the Service will function uninterrupted, secure or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements.

Indemnity

To the full extent permitted by applicable law, you hereby agree to indemnify Swiss Fiat and its partners against any action, liability, cost, claim, loss, damage, proceeding, or expense suffered or incurred if directly or indirectly arising from your use of Swiss Fiat’s Sites, your use of the Service, or your violation of these Terms of Use.

Miscellaneous

If we are unable to perform the Services outlined in the Terms of Use due to factors beyond our control including but not limited to an event of force majeure, change of law, or change in sanctions policy, we shall not be liable for the Services provided under this agreement during the time period coincident with the event.

Modification of Terms

Swiss Fiat reserves the right to change, add, or remove parts of these Terms of Use at any time and at its sole discretion. You will be notified of any changes in advance through your Account. Upon such notification, it is your responsibility to review the amended Terms of Use. Your continued use of the Site signifies that you accept and agree to the changes.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms of Use at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

Email Communication

Unencrypted email messages sent over the Internet are not secure and Swiss Fiat is not responsible for any damages incurred as a result. We suggest existing Members always log in and use the internal secure messaging system by clicking “Support” in the footer.

Swiss Fiat will never contact you from an email account that does not end with @swissfiat.com. If you ever receive an email from another address, notify our compliance department immediately at info@swissfiat.com.

Recording Your Communication With Us

You agree that we may record any telephone, email and chat conversations with you, as well as other communications and transactions, and that the recordings may be used as evidence in any proceedings relating to our Agreement with you. These records will be our sole property.
